M 218 88.04(2)(b) AWAKE STAFF FOR CONTINUOUS
Based on record review and interview, the provider did not ensure that a caregiver was present and awake at all times. Resident 1 was identified as in need of 24 hour supervision and on 05/20/2026, was unsupervised for at least 30 minutes. Findings include: On 06/16/2026, the Department received a complaint that alleged that on 05/20/2026, the home was unsupervised for at least 30 minutes while Resident 1 was home. Complaint stated that there was no staff in the home while Manager A was gone. Caregiver B was in the basement but was off the clock. Caregiver B had worked the previous day 05/19/2026 8:00 PM to 05/20/2026 8:00 AM. Complaint stated the visit took place at 8:30 AM on 05/20/2026. On 08/12/2026 at 9:00 AM, Surveyor interviewed Manager A. Manager A acknowledged that s/he was on duty on 05/20/2026. Manager A acknowledged that s/he left the home briefly to pick up medications at a nearby pharmacy. Surveyor asked if there was a staff in the home while Manager A was gone. Manager A stated that there was Caregiver B was in the basement at the time. Surveyor asked where Resident 1 was during that time. Manager A stated, S/he was probably in his/her room on main level. M 458 88.07(3)(a) PRESCRIPTION MEDICATIONS
Based on observation and interview, the provider did not ensure that prescription medications were securely stored. Resident 1 was able to unlock the medication closet with his/her fingernail. Findings include: On 08/12/2026 at 9:00 AM, Surveyor interviewed Resident 1. Resident 1 stated that caregivers were not always at the home, especially on weekends. Surveyor asked Resident 1 how s/he gets fed, receives medication and services. Resident 1 stated, "I am pretty independent. I can cook for myself, clean, do laundry." Surveyor asked Resident 1 how s/he receives medications if staff are not around. Resident 1 replied, "Oh, the medication closet isn't really locked. I can unlock the lock using my fingernail." Surveyor stated that s/he did not believe Resident 1. Resident 1 walked to the medication closet and twisted the doorknob showing that the door was locked. Resident 1 then inserted his/her fingernail into the lock and rotated his/her finger unlocking the door. Resident 1 then twisted the doorknob and the medication closet door opened. Surveyor told Resident 1 to lock the door and shut it. Resident 1 closed and locked the door. Surveyor was able to unlock the door using his/her f
